Terms and Conditions of Sale

1. Seller identity and scope
These Terms and Conditions of Sale govern sales made on klswear.com between KLSWEAR, a French simplified joint-stock company with share capital of €5,000, registered with the Paris Trade and Companies Register under number 108 498 106, with its registered office at Bureau 326, 59 rue de Ponthieu, 75008 Paris, France, contact: contact@klswear.com, and any individual acting for non-professional purposes.
Confirming an order constitutes acceptance of these terms in the version applicable on the order date.
2. Products
Essential product characteristics are presented on each product page. Photographs and renderings are illustrative and may show slight differences in color or detail depending on screens and production runs, without affecting essential product characteristics. Offers are valid while stocks last.
3. Prices
Prices are shown in euros, including tax where applicable. Shipping costs are shown before final order confirmation. For delivery outside the European Union, customs duties, local taxes or import fees may be charged by the destination country and, unless stated otherwise, are the customer's responsibility.
The price charged is the price shown when the order is confirmed, except in the event of an obvious error.
4. Orders
The customer selects the products, checks the cart and contact details, reviews the total price and these terms, then confirms the order using the button indicating an obligation to pay. The sale is concluded when KLSWEAR sends an order confirmation by email.
KLSWEAR may refuse or cancel an order for a legitimate reason, including suspected fraud, a payment issue, an abnormal request or a previous unresolved dispute. If a product becomes unavailable after the order is placed, the customer is informed and any amount paid for that product is refunded.
5. Payment
Payment is due when the order is placed. Available payment methods are shown at checkout. Transactions are processed by the payment providers offered on the site. KLSWEAR does not have access to the customer's complete bank details.
6. Delivery
Unless otherwise stated at checkout, orders are generally prepared and dispatched within 24 to 48 business hours. Estimated delivery is 7 to 15 days for France, Spain and the United Kingdom, and 20 to 30 days for other available destinations. The date or timeframe shown at checkout takes priority. Unless otherwise stated, delivery will take place no later than thirty days after the contract is concluded.
The risk of loss or damage transfers to the customer when they physically receive the product, unless the customer independently appoints a carrier not offered by KLSWEAR.
7. Right of withdrawal and returns
The customer has fourteen (14) days from receipt to inform KLSWEAR of the decision to withdraw, without giving a reason. This right also applies to sale and promotional items, except where a legal exception applies.
The request can be emailed to contact@klswear.com or submitted through the returns feature in the customer account. The customer then has fourteen days to return the product according to the instructions received. The logistics address and applicable label are provided by customer service. No parcel should be sent to the registered office without prior instructions.
Returns from France are free when using the label provided by KLSWEAR. From another country, direct return costs are the customer's responsibility unless the product is defective, the order was prepared incorrectly or the costs must otherwise be covered by law.
KLSWEAR refunds the amounts received, including the original standard delivery costs, within fourteen days after notification. The refund may be deferred until the product is recovered or proof of shipment is received. Additional costs resulting from a more expensive delivery method than standard delivery are not refunded.
The right of withdrawal does not apply in particular to products made to the customer's specifications or clearly personalized, or to sealed products that cannot be returned for health protection or hygiene reasons once unsealed.
8. Statutory warranties
The customer benefits from the statutory guarantee of conformity provided by Articles L. 217-3 et seq. of the French Consumer Code and the warranty against hidden defects provided by Articles 1641 et seq. of the French Civil Code. If a problem occurs, contact contact@klswear.com with the order number and relevant information.
In the event of non-conformity, the customer may request repair or replacement under the conditions provided by law. Where these solutions are impossible, disproportionate, refused or delayed under the applicable legal conditions, the customer may obtain a price reduction or termination of the sale. These statutory warranties apply independently of any commercial warranty.
9. Personal data and intellectual property
Data needed to manage orders is processed in accordance with the Privacy and Cookies Policy. Purchasing a product does not transfer any intellectual property rights attached to trademarks, designs, photographs, content or creations.
10. Complaints and mediation
Any complaint must first be submitted in writing to contact@klswear.com. KLSWEAR is currently finalizing its membership in a consumer mediation scheme. The competent mediator's contact details will be added to this page once confirmed. This information does not limit the customer's right to bring a claim before the competent court.
11. Governing law and disputes
These terms are governed by French law, without depriving the customer of any mandatory, more protective provisions that may apply in their country of residence. If no amicable solution is reached, the customer may bring the matter before the competent court under the rules applicable to consumers.
